3) Using the website
You agree to use the site for lawful purposes only and not to place fraudulent, speculative, or false orders. We may cancel such orders and, where appropriate, report them.
4) Orders and contract formation
Placing an order is an offer to purchase. An order is accepted when we send a dispatch confirmation (or otherwise confirm acceptance). If we cannot accept an order, we may cancel it and refund any payment received.
5) Pricing and errors
Prices are shown in NZD and include GST where applicable, unless stated otherwise. We may correct genuine pricing or listing errors and may cancel affected orders and refund payment where required.
6) Pre-orders
Pre-order ETAs are estimates and may change due to supplier or freight delays. Where permitted, we may cancel and refund a pre-order if supply becomes unavailable. Special order items may not be cancellable once ordered in.
7) Risk and title
Title passes to you when payment is received in full. Risk passes on delivery in accordance with our Shipping policy and applicable consumer law.
8) Intellectual property
All content on this site is owned by us or our licensors. You may use it for personal shopping purposes only and not for commercial reuse without permission.
9) Loyalty programme (Aqua Points)
Aqua Points may be offered from time to time and is subject to additional terms, including eligibility, earning and redemption rules, expiry, and misuse. By participating in Aqua Points, you agree to the Aqua Points Terms published on our website, as updated from time to time.
10) Promotions
Promotions (including seasonal sales and events) may be offered from time to time and are subject to additional terms, including eligibility, exclusions, non-stacking rules, and returns conditions. By purchasing during a Promotion, you agree to the Promotion Terms published for that Promotion, as updated during the Promotion period.
Nothing in any promotion or loyalty terms limits your rights under the Consumer Guarantees Act 1993 or other non-excludable rights under New Zealand law.
11) Limitation of liability
Nothing in these Terms limits rights and remedies that cannot be excluded under New Zealand law. Subject to that, we are not liable for indirect or consequential loss.
12) Governing law
These Terms are governed by the laws of New Zealand and disputes are subject to New Zealand courts.
