This document (together with any other documents herein mentioned) sets forth the terms and conditions governing the use of this website (www.aquahouse.co.nz) and the purchase of items through this "Site" (hereinafter, the "Terms").
Please read through these Terms, our Cookies Policy and our Privacy Policy (hereinafter, jointly, the “Data Protection Policies”) prior to using this website or placing an order on it.
By using this website or placing an order through it, you are consenting to be bound by these Terms and our Data Protection Policies as well as Shipping & Return Policy. If you do not agree to all of the Terms and the Data Protection Policies, do not use this website.
These Terms and the Data Protection Policies may be amended. It is your responsibility to regularly read through them, as the Terms and the Data Protection Policies in force at the time that you use this website or at the time of the formation of the Contract (as defined below) will be the applicable ones.
By purchasing any item from this website, you enter into a contract with us on these terms.

Your Details and your visits to this Site
The information or personal details that you provide us with will be processed pursuant to the Data Protection Policies. By using this website you are consenting to the processing of such information and details and you represent that the whole information or details you have provided us with are true and accurate.

Use of our Website
By using this website "Site" and/or by placing any order through it, you undertake:
(a) To use the website exclusively to make legitimate enquiries or orders.
(b) Not to make any speculative, false or fraudulent orders. If we are reasonably of the opinion that such an order has been made, we will be entitled to cancel the order and inform the relevant authorities.
(c) To provide correct and accurate e-mail, postal and/or other contact details to us and acknowledge that we may use these details to contact you in the event that this should prove necessary (see our Data Protection Policies). If you do not give us all of the information that we need, we may not be able to complete your order.
By placing an order through this website, you represent and warrant that you are at least 18 years old and are legally capable of entering into binding contracts.

How the Contract is formed
The information set out in the Terms and the detail contained on this website do not constitute an offer for sale, but rather an invitation to treat. No contract in respect of any items will exist between us and you until your order has been expressly accepted by us, whether or not funds have been deducted from your account. If we do not accept your offer and funds have already been deducted from your account, these will be fully refunded. To place an order, you must follow the online shopping process and click on "Authorise payment" to submit the order. After this, you will receive an email from us confirming receipt of your order (the "Order Confirmation"). Please note that this does not mean that your order has been accepted. Your order constitutes your offer to us to buy one or more items from us. All orders are subject to acceptance by us, and we will confirm this acceptance to you by sending you an email that confirms that the item is being sent (the "Shipping Confirmation"). The contract for the purchase of an item between us (the "Contract") will only be formed when we send you the Shipping Confirmation. The Contract will relate only to those items for which we have confirmed dispatch in the Shipping Confirmation. We will not be obliged to supply any other items which may have been part of your order, until the dispatch of those items has been confirmed in a separate Shipping Confirmation.

Intellectual Property
You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content supplied as part of this website will remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorised by us or our licensors. This does not prevent you using this website to the extent necessary to make a copy of any order or Contract details.

Aqua Points Terms
Earning Points: Points are awarded for eligible purchases and other activities as specified by Aqua House. To collect points, customers must be actively subscribed to our email marketing.
Redeeming Points: Points can be redeemed for selected selected in the program discounts. Points cannot be redeemed for cash or used alongside other payment methods unless otherwise stated.
Points Expiration: Points may expire after a set period if not redeemed. Expiration dates will be communicated via email or on our website.
Changes to the Program: Aqua House reserves the right to modify, change, or discontinue the points conversion, earning methods, and redemption methods at any time without prior notice.
Account Eligibility: The loyalty program is open to all registered customers with an active account. Points are non-transferable and can only be used by the account holder.
Misuse of Points: Any misuse of the program, including fraudulent activity, may result in the suspension of the account and forfeiture of all points.

 

Shipping policy

 How long is the order processing period?

Order processing times are between 1-2 business days after the day you place your order. Most packages are prepared within 48 hours, but if our warehouse is exceptionally backed up, processing times may go up to 4 business days following the day you placed your order. If your order has been processed for more than four business days, please contact us, and we'll help you.

I received a damaged item. What do I do?

We apologise that your shipment didn't arrive in perfect condition! Please Contact Us with your name and order number for further assistance.

Can I edit my shipping address after my order has been placed?

Once an order is placed, our warehouse staff can pack and ship out your order, so it's not always possible to process address change requests. If you notice an error, please email us ASAP with your name and order number so we can try to correct your package before it departs. There's no guarantee we can make it, especially once it leaves our warehouse, but we'll do everything we can!

Pick Up in Store

Once your "Pick Up in Store" order has been prepared, we will inform you that it is ready to be picked up. You can pick up the order either in person (by presenting the order number and proof of identity) or appoint someone else to pick up the order on your behalf. In such cases, the appointed person must present the order number and proof of his or her identity.

Unable to deliver

If after 15 days from the date your order is available for delivery, the order could not be delivered or was not picked up for reasons not caused by us, we will assume that you wish to cancel the Contract and will be deemed terminated. As a result of the termination of the Contract, we will return to you all payments received from you, excluding delivery charges, within 30 days of the date on which this Contract has been terminated. 

 

Refund policy

 

General Info

If you're looking to return or exchange your order for whatever reason, we're here to help! We offer returns or exchanges within 14 days of receiving your order. You can return your product for store credit, a different product, or a refund to the original payment method.

Please note the following exceptions to our return and exchange policy:
- Discounted items are final and cannot be returned or exchanged.
- Returned items must have tags still on and be returned in original packaging.
- Returned items must have no signs of wear or use.
- Gifted items are not exchangeable. 
- Gifted items must be returned with ordered items unless we agree otherwise. 

To initiate a return or exchange, please complete the following steps:
- Login to our online return portal using your email address and order ID.
- Choose the products you wish to return or exchange from your order.
- Print your prepaid shipping label that you will receive by email.
- Send all items back to us using the label provided.

Please allow up to 14 days for your return to be processed. All refunds will be provided via the original method of payment.

When will I get my refund?

Your refund will be processed as soon as our quality assurance team inspects the product you have returned and it is confirmed that it fits within our returns policy. This quality check can take up to 2 weeks, though generally less. Once the return has been approved, it takes 1-2 days for the refund to be made by Aqua House to your payment services provider (for example, your credit card supplier).

Please note that the time taken for a payment services provider to provide you with your refund can vary depending on the provider. For further information, please call our online shop customer service team (number at the bottom of the page) and let the advisor know the details of your order and/or your open question. Our online shop customer service team is available Monday through Friday from 10am to 4pm. Our advisors are happy to assist you.

What Should I do if my product arrives damaged or defective or isn't what I ordered? 

If you have received a damaged or defective product, please return the product as per the return instructions. If you have received the incorrect order, please contact our customer service advisors (number at the bottom of the page) and let the representative know the details of your order, and they will assist you further. They are available Monday through Friday from 10am to 4pm.

Will you refund my shipping/delivery costs if I return my order?

We will refund the cost of the returned products. We will not refund the shipping costs.

Personal Information we collect
When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We use the Order Information that we collect generally to fulfil any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations).  Any of the information we collect from you may be used in one of the following ways:

To administer a contest, promotion, survey or other site feature
To send periodic emails (The email address you provide for order processing, may be used to send you information and updates pertaining to your order, in addition to receiving occasional company news, updates, related product or service information, etc. Note: If at any time you would like to unsubscribe from receiving future emails, If at any time you would like to unsubscribe from receiving future emails, please send a message to sales@4tradeshop.co.nz and you will be deleted from the mailing lists within 24-48 business hours.)

Children's Online Privacy Protection Act Compliance
We are in compliance with the requirements of COPPA (Childrens Online Privacy Protection Act), we do not collect any information from anyone under 13 years of age.  Our website, products and services are all directed to people who are at least 13 years old or older.  The Site is not intended for individuals under the age of 13.

Do we disclose any information to outside parties?
We do not sell, trade, or otherwise transfer to outside parties your personally identifiable information. This does not include trusted third parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others rights, property, or safety. However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.

Sharing your personal information.
